Former News of the World editor Andy Coulson and ex-Royal editor Clive Goodman are to face a retrial following the phone hacking case.
The pair will face a fresh trial on allegations they paid police officers for Royal phone directories for the purposes of hacking.
Last week, a jury at the Old Bailey could not decide whether the pair were guilty of the two counts.
Former No 10 spin doctor Coulson, 46, and Goodman, 56, deny the two charges of conspiring to commit misconduct in public office.
The Crown Prosecution Service announced it would still pursue both defendants over the two counts.
Prosecutor Andrew Edis QC said: “The CPS has taken the position to proceed with the retrial.”
Coulson already faces jail after he was found guilty of plotting to hack phones at the News of the World between 2000 and 2006.
It followed an Old Bailey trial which went on for 139 days.
Goodman, from Addlestone, Surrey, pleaded guilty to phone hacking in 2006 and despite admitting his activities were more extensive than he had previously said, he will not face further action.
Coulson, from Charing, Kent, was joined in the dock by private detective Glenn Mulcaire and four former News of the World journalists who all admitted hacking before the trial began.
Lawyers are to mitigate for the defendants before Mr Justice Saunders hands down sentences on Friday.
